Terms of service
Welcome to LB Hyper (Pty) Ltd, trading as LB's Hyper. These Terms and Conditions govern Orders placed through the Website and must be read with the other policies referenced in this legal suite.
1. Scope and acceptance
By placing an Order, you confirm that you have read and accepted these terms and the policies incorporated by reference.
You must have legal capacity to enter into the transaction. A person acting for another person or entity warrants that they have authority to do so.
Mandatory consumer rights continue to apply and prevail over any inconsistent term.
2. Product information
We take reasonable care to describe Products accurately. Images may be illustrative and colours, packaging, dimensions or minor details may differ because of screens, supplier updates or manufacturing changes.
Customers must read the product page, specifications, warnings, ingredients, size guides, feeding guidance and suitability information before purchase and use.
A Product is not veterinary, medical or nutritional advice. Consult an appropriate professional where a pet has allergies, medical conditions, special dietary needs or other risks.
3. Orders and contract formation
Submitting an Order is an offer to purchase. An automated Order Acknowledgement confirms receipt but does not by itself mean that we accepted the Order.
We accept an Order when we expressly confirm acceptance, begin fulfilment or issue dispatch confirmation, whichever occurs first.
We may reject or cancel an Order before acceptance for stock unavailability, payment failure, suspected fraud, pricing or description errors, delivery limitations, legal restrictions or another reasonable operational reason.
If we cancel after receiving cleared funds, we will refund the affected amount using the original payment method unless another lawful arrangement is agreed.
4. Prices and availability
Prices are displayed in South African rand (ZAR). Delivery fees, heavy or bulky surcharges and other disclosed charges are added where applicable.
Promotional prices apply only during the stated period and while allocated stock lasts.
Stock indicators are not guarantees. Inventory can change before fulfilment, particularly where Products are held by independent Suppliers.
If a material price, product or promotion error is identified, we may contact you for instructions or cancel and refund the affected item. We will not substitute a materially different Product without consent.
5. Payment
Payment must be authorised through a payment method offered at checkout. We may perform or request reasonable fraud, identity or payment verification.
An Order may be held, declined or cancelled if payment is not authorised, reversed, disputed or reasonably suspected to be unlawful.
Third-party payment providers process payment information under their own security and privacy terms.
6. Delivery, returns and warranties
Delivery is governed by the Shipping Policy and Delivery and Risk Policy.
Returns, refunds and cancellations are governed by the Return, Refund and Cancellation Policy.
Products must be used, stored and maintained in accordance with the manufacturer instructions and for their intended purpose.
7. Liability
To the maximum extent permitted by law, we are not liable for indirect, special or consequential loss that was not reasonably foreseeable when the contract was formed.
We are not responsible for loss caused by inaccurate Customer information, misuse, unauthorised alteration, failure to follow warnings or instructions, normal wear and tear, or events outside our reasonable control.
Nothing limits liability for fraud, gross negligence, death or personal injury caused by negligence, defective-product liability that cannot be excluded, or any other liability that the law prohibits us from limiting.
8. General
If a term is invalid or unenforceable, it will be adjusted or severed only to the minimum extent necessary and the remaining terms continue.
A failure or delay to enforce a right is not a waiver.
South African law governs these terms. Courts, tribunals, regulators and recognised alternative dispute resolution bodies with jurisdiction may hear disputes.
We may update these terms prospectively. The version applicable to an accepted Order is normally the version published when that Order was placed, unless a change is required by law or benefits the Customer.
Payment Policy
This policy explains payment processing for Orders placed with LB Hyper (Pty) Ltd, trading as LB's Hyper. Available methods are those displayed at checkout.
1. Currency and charges
All charges are in South African rand (ZAR) unless expressly stated otherwise.
The amount payable includes the Product price, delivery fees and any disclosed heavy, bulky or other surcharge. Discounts are applied according to their terms.
Any bank, card, exchange-rate, data or third-party fee imposed directly on the Customer by their provider is the Customer’s responsibility.
2. Payment authorisation
Payment is subject to authorisation by the Customer’s bank, card issuer, wallet provider or other payment service.
An authorisation, pending charge or payment receipt does not guarantee Order acceptance or stock allocation.
We may delay fulfilment while payment or fraud verification is pending.
3. Security and payment providers
Payments are processed through third-party payment gateways and financial institutions using their own systems and security controls.
Customers must not send complete card details, passwords, PINs or one-time passwords by email, chat or social media.
We do not intentionally store complete payment-card numbers or card security codes on our own systems.
4. Failed, reversed or disputed payments
An Order may be declined, held or cancelled if payment fails, is reversed, is subject to chargeback, appears unauthorised or cannot be verified.
We may recover lawful amounts, costs or Products where a completed payment is later reversed without a valid basis, subject to applicable law.
A Customer should contact us before initiating a payment dispute so that we can try to resolve the underlying issue.
5. Refunds
Refunds and cancellations follow the Return, Refund and Cancellation Policy and applicable law.
A refund is normally sent to the original payment method. Processing times after initiation depend on the payment provider and bank.
We will not knowingly refund to an unrelated third party.
6. Invoices and records
Order and payment records may be issued electronically.
Tax treatment and invoice wording will reflect our legal registration status at the time of supply and applicable South African law.
Order Processing Policy
This policy explains how LB Hyper (Pty) Ltd, trading as LB's Hyper, receives, verifies, accepts, fulfils, changes and cancels Orders.
1. Order submission
The Customer is responsible for checking Product, quantity, variant, price, Delivery Address and contact details before submitting an Order.
An Order Acknowledgement confirms receipt only. It does not guarantee acceptance, stock or dispatch.
2. Verification
We may request identity, address, payment or other reasonable verification for fraud prevention, legal compliance or delivery security.
Failure to provide reasonable verification may delay or prevent acceptance.
3. Stock and Supplier confirmation
Some Products are sourced or fulfilled by independent Suppliers. Stock is not final until confirmed and allocated.
If a Product becomes unavailable, we may offer a wait, alternative or cancellation. We will not substitute a materially different Product without consent.
If only part of an Order is unavailable, we may fulfil the available items and refund the unavailable items, after considering delivery practicality and the Customer’s instructions.
4. Pricing and listing errors
We may correct an obvious pricing, description, image, promotion, shipping or system error before Order acceptance.
Where an error materially affects an Order, we will contact the Customer for instructions or cancel and refund the affected amount.
We will not rely on an error correction to remove a statutory right after a binding contract has formed.
5. Cancellation requests
A Customer may request cancellation before dispatch or irreversible Supplier processing, but cancellation is not guaranteed once fulfilment has started.
If cancellation is possible, we will refund the unfulfilled amount. Lawful non-recoverable special-order or service costs may be considered only where clearly disclosed and permitted.
If cancellation is no longer possible, the Customer may use any applicable Return right after delivery.
6. Order changes
Changes to Products, quantities, addresses or payment methods are not guaranteed after submission and may require cancellation and a new Order.
A requested change may affect price, stock, delivery fee, free-delivery qualification and delivery timing.
7. Split fulfilment and communications
An Order may be split among Suppliers or parcels. Each parcel may have separate tracking or delivery timing.
Customers should keep Order communications and quote the order number when contacting support.
Promotions, Discount Codes and Gift Vouchers
This policy applies to promotions, competitions linked to sales, discount codes, free-delivery offers and gift vouchers offered by LB Hyper (Pty) Ltd, trading as LB's Hyper. Specific promotion terms may add to or vary this policy.
1. General promotion rules
A promotion applies only during the stated period, to eligible Products and Customers, and while allocated stock or budget lasts.
A promotion may be limited by minimum spend, maximum discount, geographic area, channel, payment method, account, household or number of uses.
Discounts have no cash value and cannot be transferred or sold unless the specific terms allow it.
2. Discount codes
A code must be entered correctly before payment. A discount cannot normally be added after an Order is completed.
Only one code may be used per Order unless the specific promotion expressly permits stacking.
Codes may exclude delivery charges, heavy or bulky surcharges, selected Products, bundles, already discounted items or other stated categories.
3. Free-delivery promotions
The ordinary free standard delivery threshold applies after discounts unless specific promotion terms state otherwise.
Free standard delivery does not automatically waive a disclosed heavy, bulky, oversized, remote-area or special-handling surcharge.
4. Returns from promotional Orders
A refund reflects the amount actually paid for the returned Product after allocation of the promotion or discount.
Where a partial voluntary Return means the retained Order no longer met a minimum-spend or free-delivery condition, we may recalculate the promotion or deduct the applicable standard delivery charge where lawful and disclosed.
Statutory defect and cooling-off rights are not reduced by a promotion.
5. Errors, misuse and fraud
We may refuse or reverse a promotion obtained through manipulation, duplicate accounts, automated abuse, false information, unauthorised code publication, payment fraud or a clear system error, subject to law.
We may correct an obvious promotion error before Order acceptance and will refund any affected payment if the Order is cancelled.
6. Gift vouchers
This section applies only when gift vouchers are offered.
Voucher validity, expiry, permitted uses, balance rules and exclusions will be stated when issued and must comply with applicable law.
A voucher is not redeemable for cash except where the law requires. Lost, stolen or unauthorised vouchers may not be replaced where the value has been used, unless the circumstances and law require otherwise.
Vouchers may not be used to buy another voucher unless expressly allowed.
Website Terms of Use
These Website Terms of Use govern access to and use of www.lbshyper.co.za, content, accounts, reviews, communications and technical services operated by LB Hyper (Pty) Ltd, trading as LB's Hyper. Purchase transactions are additionally governed by the Terms and Conditions of Sale.
1. Permitted use
You may use the Website for lawful personal or authorised business shopping, product research, account management and communication with us.
You must provide accurate information and safeguard account credentials and devices used to access the Website.
2. Prohibited conduct
· Accessing or attempting to access accounts, systems, data or functions without authority.
· Introducing malware, harmful code, denial-of-service activity or security testing without written permission.
· Scraping, copying, crawling or using automated tools in a manner that overloads, disrupts or commercially exploits the Website without permission.
· Submitting false, unlawful, defamatory, infringing, abusive, deceptive or harmful content.
· Using the Website for payment fraud, resale abuse, promotion manipulation or unlawful activity.
3. Accounts
You are responsible for activity under your account unless caused by our breach. Notify us promptly of suspected unauthorised access.
We may suspend or restrict access where reasonably necessary for security, investigation, maintenance, legal compliance or material breach.
4. Intellectual property
The Website, branding, logo, layout, original text, graphics and software are owned by or licensed to us and protected by applicable intellectual-property law.
Product names, images and trademarks may belong to Suppliers or other rights holders.
No content may be reproduced, modified, distributed, sold, framed or commercially exploited without permission, except for lawful personal use or as allowed by law.
5. Reviews and user content
Content submitted to us must be honest, relevant, lawful and, where represented as a review, based on genuine experience.
You grant us a non-exclusive, worldwide, royalty-free licence to host, reproduce, moderate and display submitted content for operating and promoting the business, subject to privacy law.
We may remove content that violates these terms, exposes personal information, contains prohibited claims or is reasonably suspected to be fraudulent.
6. Availability and third-party links
We do not guarantee uninterrupted or error-free Website availability. Maintenance, security incidents, network failures and third-party systems may affect access.
Links or integrations to third-party websites and services are provided for convenience. Their operators are responsible for their own content, security, availability and terms.
7. Website information and disclaimers
General Website content is provided for retail information and is not professional veterinary, medical, legal or financial advice.
We take reasonable care but do not warrant that all Website information is always complete, current or error-free. Transaction errors are handled under the Terms and Conditions of Sale and applicable law.
8. Enforcement and law
We may take reasonable technical or legal steps to protect the Website, Customers, Suppliers and our rights.
South African law governs these terms. Nothing prevents a person from approaching a regulator, ombud, tribunal or court with jurisdiction.
